1. Scope

These Terms of Service apply to the use of the web application "Altura" (hereinafter "Service"), operated by:

2. Service Description

Altura is a web application for personal transformation and habit development. The service offers:

  • 25-year vision planning
  • Habit tracking using the Atomic Habits methodology
  • Identity-based goal setting
  • Daily, weekly, and monthly reviews
  • Calendar and time block planning
  • AI-assisted coaching (depending on plan)

3. Contract Formation

3.1 By registering a user account, a contract for the use of the service is established.

3.2 A valid email address is required for registration. You must be at least 16 years old.

3.3 You are obligated to keep your login credentials confidential and protect them from third-party access.

4. Plans and Pricing

4.1 The service is offered in the following plans:

  • Free: Free, with limited features
  • Pro: $19/month or $149/year ($12.42/month)

4.2 All prices include applicable VAT.

4.3 Price changes will be announced at least 30 days in advance and will apply from the next billing period.

5. Payment

5.1 Payment is processed through our payment provider Stripe via credit card or other offered payment methods.

5.2 For monthly payments, the amount is charged on the anniversary of initial registration. For annual payments, accordingly once per year.

5.3 In case of payment default, we reserve the right to restrict access to paid features.

6. Right of Withdrawal

6.1 As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason.

6.2 The withdrawal period is 14 days from the day the contract is concluded.

6.3 To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g., by email to info@getaltura.app).

6.4 In case of a valid withdrawal, we will refund all payments received without delay, at the latest within 14 days.

7. Cancellation

7.1 You can cancel your subscription at any time effective at the end of the current billing period.

7.2 Cancellation is done through account settings or by email to info@getaltura.app.

7.3 After cancellation of a paid plan, your account will be converted to the Free plan. Your data remains intact, but access to premium features will be restricted.

7.4 In case of violation of these Terms, we reserve the right to suspend or delete your account without prior notice.

8. Usage Rules

When using the service, it is prohibited to:

  • Use the service for illegal purposes
  • Introduce or distribute malware
  • Circumvent security measures
  • Overload the infrastructure
  • Upload content that violates third-party rights
  • Harass or endanger other users

9. Availability

9.1 We strive for high availability of the service but cannot guarantee it.

9.2 Maintenance work will be announced in advance when possible and performed outside peak usage times.

9.3 We are only liable for data loss due to technical failures in cases of intent or gross negligence.

10. Liability

10.1 We are fully liable for damages arising from injury to life, body, or health, as well as for intent and gross negligence.

10.2 In cases of slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damages.

10.3 The service is intended for personal organization and self-improvement. It does not replace professional medical, psychological, or financial advice.

11. Intellectual Property

11.1 All rights to the software, design, and content of the service belong to us or our licensors.

11.2 Your own content (vision, habits, journal, etc.) remains your property. You grant us only the usage rights necessary for operation.

12. Third-Party Integrations

The service offers optional integrations with third-party services:

  • Google Calendar: You may connect your Google account to sync calendar events. This integration is governed by Google's Terms of Service and API Services User Data Policy.
  • Kit (ConvertKit): If you opt-in to our newsletter, your email address will be shared with Kit for email delivery.
  • Stripe: Payment processing is handled by Stripe. Your use of payment features is subject to Stripe's Terms of Service.
  • Anthropic (AI Coach): The AI coaching feature "Auryn" is powered by Anthropic's Claude API. When you use the coach, your relevant data is processed by Anthropic in accordance with their usage policies. Anthropic does not use your data for model training.
  • OpenAI (Voice & Embeddings): Voice input is transcribed using OpenAI's Whisper API, and text-to-speech uses OpenAI's TTS API. Semantic search uses OpenAI embeddings. Audio data is processed transiently and not stored by OpenAI for training.

12.2 We are not responsible for the availability, accuracy, or practices of third-party services. You use these integrations at your own discretion.

13. Privacy

The collection and processing of personal data is governed by our Privacy Policy.

14. Changes to Terms

14.1 We reserve the right to modify these Terms when necessary and as long as you are not unreasonably disadvantaged.

14.2 You will be notified of changes by email at least 30 days before they take effect. If you do not object within 30 days, the new Terms are deemed accepted.

15. Final Provisions

15.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

15.2 Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
